Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of techifornia.com and any services provided by Techifornia IT Services ("Techifornia," "we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site.

Services

Techifornia provides managed IT, cybersecurity, network, cloud, backup, help desk, and consulting services. The scope, fees, service levels, and specific deliverables for any paid engagement are governed by a separate written Master Service Agreement, Statement of Work, or proposal ("Service Agreement"). In the event of a conflict between these Terms and a Service Agreement, the Service Agreement controls.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or engage our services on behalf of yourself or an organization.

Acceptable use

You agree not to:

Use the Site or services for any unlawful, harmful, or fraudulent purpose.
Attempt to gain unauthorized access to our systems, accounts, or networks.
Interfere with or disrupt the operation of the Site or our services.
Reverse engineer, scrape, or copy the Site except as expressly permitted.
Submit false, misleading, or infringing content.

Intellectual property

The Site, including all content, design, logos, and trademarks, is owned by Techifornia or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission, except for personal and lawful business use of publicly available content.

Third-party services

The Site may link to or integrate with third-party services. We are not responsible for the content, policies, or practices of third parties.

Disclaimers

THE SITE AND ANY UNPAID INFORMATION PROVIDED ON IT ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WARRANTIES SPECIFIC TO PAID SERVICES ARE SET FORTH IN THE APPLICABLE SERVICE AGREEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHIFORNIA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). LIABILITY FOR PAID SERVICES IS GOVERNED BY THE APPLICABLE SERVICE AGREEMENT.

Indemnification

You agree to defend, indemnify, and hold harmless Techifornia from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or breach of these Terms.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there.

Changes to these terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance.
